View Full Version : Can you get out of a car lease, if the car has had mechanical problems from the start?

I am one year into a 4 year lease. It is a used car so it will be mine when the lease is up, I won't be trading it back in, or paying penalties. The car has had mechanical problems since I got it, some of which they agreed to fix, then didn't have time so I had it fixed elsewhere and sent them the bill. There were other problems, but I just let these go because it was such a headache to get it done by them. Am I entitled to ask for a different car or get out of the lease. Or, am I stuck with no options?

Check out your state's "lemon' laws, - it is possible! Hopefully you have good doccumentation, -- this helps a lot (lawyer will "shred them" with it if it might get as far as court)!

read your lease agreement. sounds like you have some sort of warrenty, but you are not taking advantage of it.i doubt that a court would side with you based upon your description.i would check your state's lemon law, does it apply to used cars? is it the sameproblem everytime that they can't seem to fix? or is it just a series of problems?again, read your contract, was it sold as is?

First of all, lemon laws don't apply to used cars, only new cars. The problems you are experiencing won't get you out of the lease.Second, leasing is not like renting, you can't just swap cars in the middle of a lease. A lease is for a specific vehicle.Third, the car will not be yours at the end of the lease. There's a lease-end purchase price specified in your lease contract that tells you how much you'll have to pay to own the car.
